SoGo Physicians reserves the right, at any time, to change these Terms of Use, effectively immediately upon posting on the Web site or by e-mail delivery to you.
By reference and extension, these Terms of Use also apply as they may appear, to the paper-published magazine, SoGo: The Official Journal, Society of Government Physicians.

1. Use of Web site. This Web site is for use ONLY by physicians in public service who are members of SoGo Physicians. SoGo Physicians may terminate your membership at any time for breach of these Terms of Use and discontinue your use of this Web site. The information provided on this site is for general informational and educational purposes. Certain sections of this Web site are intended for particular audiences including SoGo Physicians' Advisory Board, financial collaborators/sponsors/supporters, and employees. Your access to and use of the information contained in the Web site is subject to this Terms of Use Agreement. By accessing and using this Web site, you accept, without limitation or qualification, this Terms of Use Agreement.
2. Content. SoGo Physicians will use reasonable efforts to include accurate and up-to-date information on this Web site but makes no warranties or representations of any kind as to its accuracy, currency or completeness. Everything on this Web site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. You agree that access to and use of this Web site and the content thereof is at your own risk. SoGo Physicians disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Neither SoGo Physicians nor any party involved in creating, producing or delivering this Web site shall be liable for any damages, including without limitation, direct, incidental, consequential, indirect or punitive damages, arising out of access to, use of or inability to use this Web site, or any errors or omissions in the content thereof. 3. Security. This Site is intended by SoGo Physicians to require a valid, working e-mail address and password to access and use the Web site. You are solely responsible for; 1) maintaining the strict confidentiality of your password, 2) not allowing another person to use your IDs to access the Site, 3) any damages or losses that may be incurred or suffered as a result of your failure to maintain the strict confidentiality of your personal account, and (4) promptly informing SoGo Physicians in writing of any need to deactivate an account due to potential or actual security concerns. SoGo Physicians is not liable for any harm related to the theft of your personal account or information, your authorization to allow another person or entity to access and use the Web site. You agree to immediately notify SoGo Physicians in writing of any unauthorized use of your identity or personal account or any suspected security breach thereof.
4. Indemnification. You agree to indemnify, defend and hold harmless SoGo Physicians, its employees, Advisory Board, financial collaborators/sponsors/supporters, agents, suppliers and third party partners from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation by you of these Terms of Use.
5. Privacy. SoGo Physicians respects the privacy of its Web site users. Please refer to SoGo Physicians’s Privacy Policy that explains users' rights and responsibilities with respect to information that is disclosed on this Web site.
6. Third Party Web sites and Links. This Web site may contain links or references to other Web sites maintained by third parties over whom SoGo Physicians has no control. Such links are provided merely as a convenience. Similarly, this Web site may be accessed from third party links over whom SoGo Physicians has no control. SoGo Physicians makes no warranties or representations of any kind as to the accuracy, currency, or completeness of any information contained in such Web sites and shall have no liability for any damages or injuries of any kind arising from such content or information. Inclusion of any third party link does not imply an endorsement or recommendation by SoGo Physicians.

8. Message Boards / Forums / Clinical Consult Network. Certain areas of the Site may enable you to access online forums and to submit e-mails, or otherwise provide feedback to SoGo Physicians. SoGo Physicians does not endorse, and specifically disclaims, any responsibility or liability for any content in these forums. You may not post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability or otherwise violate any law. In addition, you are prohibited from posting or transmitting any information which (a) infringes the rights of others or violates their privacy or publicity rights, (b) is protected by copyright, trademark or other proprietary right, unless with the express written permission of the owner of such right, (c) contains a virus, bug or other harmful item, or (d) is used to unlawfully collude against another person in restraint of trade or competition. You shall be solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary right, or any other harm resulting from your use of the Site. These portions of the Web site may contain members’ personal anecdotes, non-clinically proven advice and general information relating to various medical conditions and their treatment. Such information is posted anonymously and provided for informational and/or educational purposes only and is not meant to be a substitute for advice provided by a consulting physician or other qualified health care professional. Members are strongly cautioned that it is possible that not all postings originate from a member physician, but may be posted by a non-physician moderator for the purpose of stimulating a constructive dialogue. Any such postings or other information on this portion of the Web site may also be shared with SoGo Physicians’ financial collaborators / sponsors / supporters or Advisory Board. Message Board / Forums / Clinical Consult Network postings become the property of SoGo Physicians LLC and may be reprinted in any form whatsoever without permission of those making the original postings.

Subject to any applicable terms and conditions set forth in our Privacy Policy, any communication or other material that you send to us through the Internet or post on a SoGo Physicians Web site by electronic mail, message board / Clinical Consult Network posting or otherwise, such as any questions, comments, suggestions or the like, is and will be deemed to be non-confidential and SoGo Physicians shall have no obligation of any kind with respect to such information. SoGo Physicians shall be free to use any ideas, concepts, know-how or techniques contained in such communication for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products. Any such information may also be shared with SoGo Physicians’ financial collaborators/sponsors/supporters.
10. Trademarks. All product names, whether or not appearing in large print or with the trademark symbol, are trademarks of SoGo Physicians, its affiliates, related companies or its licensors or joint venture partners, unless otherwise noted. The use or misuse of these trademarks or any other materials, except as permitted herein, is expressly prohibited and may be in violation of copyright law, trademark law, the law of slander and libel, the law of privacy and publicity, and communications regulations and statutes. Please be advised that SoGo Physicians actively and aggressively enforces its intellectual property rights to the fullest extent of the law.

12. Governing Laws. This Terms of Use Agreement and your use of the Web site shall be governed by the laws of the United States of America and the State of New Jersey without regard to its conflicts of laws principles. Any legal action or proceeding related to this Web site shall be brought exclusively in a federal or state court of competent jurisdiction sitting in New Jersey.
13. Miscellaneous. If any provision of this Agreement is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions. SoGo Physicians reserves the right to alter or delete materials from this Web site at any time at its discretion.
